Associated Press reported the Joint Standing Committee was taking into account the expected drop in coal mined in the state. West Virginia will likely produce about 130 million tons of coal a year after 2010, down from 140 million tons annually.
The tax was originally doubled in 2001 to finance the state's Special Reclamation Fund, which restores abandoned mine sites.
The council's advice is due by next year’s regular session.
